1. Acceptance of Terms
These Terms & Conditions ("Terms") are an agreement between you and MangalUtsav ("we", "us" or "our"). They govern your access to and use of our website and services.
By browsing the site, creating an account, listing a business or contacting a vendor through us, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the platform.
2. What We Are (And Are Not)
MangalUtsav is a directory and discovery platform. We help customers find event professionals — decorators, caterers, photographers, venues, DJs and others — and put the two sides in touch.
We are not a party to any booking. We are not an agent, broker, event planner, guarantor or employer of any vendor listed on the platform. Every vendor is an independent business. Any contract, quotation, payment, deposit, cancellation or refund is agreed directly between you and the vendor, and we are not a party to it.
We do not take a commission on bookings made through the platform, and we do not process payments between customers and vendors.
What "Verified" means
A "Verified" badge means we carried out a basic check on the business details submitted to us before approving the listing. It is not a guarantee of the quality, safety, legality, licensing, insurance or reliability of that vendor's work, and it is not a recommendation or endorsement. You remain responsible for satisfying yourself about any vendor before engaging them.
3. Eligibility & Accounts
- You must be at least 18 years old and legally capable of entering into a contract.
- You must provide accurate, current and complete information when registering, and keep it up to date.
- You are responsible for keeping your password confidential and for all activity that happens under your account.
- You must notify us immediately at hello@mangalutsav.in if you suspect unauthorised use of your account.
- You may not create an account on behalf of someone else without their authority, or maintain multiple accounts to evade a suspension.
4. Terms for Customers
- Browsing and contacting vendors on MangalUtsav is free.
- When you submit an enquiry, reveal a phone number or start a WhatsApp chat, your contact details are shared with that vendor so they can respond. See our Privacy Policy for details.
- Listing information — including prices, packages and availability — is supplied by the vendor. We do not independently verify it and it may change without notice. Confirm all details directly with the vendor.
- You agree to send genuine enquiries only. Do not use the platform to send spam, marketing messages or bulk enquiries to vendors.
- We cannot guarantee that a vendor will respond to your enquiry, be available on your date, or honour any indicative pricing shown on their listing.
- Any dispute about a booking, service quality, payment or refund is between you and the vendor. We may, at our discretion, try to help resolve it, but we are under no obligation to do so and have no liability for the outcome.
5. Terms for Vendors
If you register a business on MangalUtsav, the following additional terms apply.
- Approval: new listings are reviewed before going live. We may approve, reject or request changes at our discretion, and we are not obliged to give reasons.
- Accuracy: you warrant that all listing information is true, that you hold any licences, registrations and permissions required to provide your services, and that you will keep your listing current.
- Rights in content: you warrant that you own or are licensed to use every photograph, logo and description you upload, and that they do not infringe anyone's copyright, trademark or other rights. Do not upload images you found online or that belong to another business.
- Responding to leads: you agree to respond to enquiries professionally and within a reasonable time, and to honour the services and pricing you advertise.
- Customer data: enquiry details are shared with you solely so you can respond to that enquiry. You must not add enquirers to marketing lists, sell or share their details, or use them for any unrelated purpose. You are independently responsible for complying with applicable data protection law in how you handle them.
- No manipulation: you must not post or solicit fake reviews, review your own business, review a competitor, or offer incentives in exchange for positive reviews.
- Licence to us: by uploading content you grant us a non-exclusive, royalty-free, worldwide licence to host, display, resize and promote that content on the platform and in our own marketing while your listing is active.
- Removal: we may edit, suspend or permanently remove a listing that breaches these Terms, receives repeated credible complaints, or is inactive or unresponsive.
6. Subscription Plans & Payments
- Vendors may list on a free plan or subscribe to a paid plan for additional visibility and features. Current plans and inclusions are shown on our Pricing page.
- Plan features, prices and inclusions may change. Changes will not affect the price of a plan period you have already paid for.
- A paid plan runs for the period stated at the time of purchase and does not renew automatically unless we tell you otherwise in writing.
- Paid plans buy placement and features on the directory only. They do not guarantee any number of enquiries, leads, bookings, views or revenue.
- Subscription fees are non-refundable except where required by law or where we withdraw the service ourselves. If we terminate your listing for a breach of these Terms, no refund is due.
- Fees are exclusive of applicable taxes unless stated otherwise.
7. Reviews & User Content
- Reviews must reflect your own genuine experience with the vendor.
- Do not post content that is false, defamatory, abusive, obscene, discriminatory, or that reveals someone's private information.
- You remain responsible for anything you post. By posting, you grant us a non-exclusive, royalty-free licence to display, reproduce and distribute it on the platform.
- We may moderate, edit or remove content that breaches these Terms, but we are not obliged to monitor content and we do not endorse any opinion expressed in a review.
- Ratings shown on a listing are an aggregate of user submissions and are not our assessment of the vendor.
8. Prohibited Use
You must not:
- Use the platform for any unlawful, fraudulent or deceptive purpose
- Scrape, crawl, harvest or bulk-download listings, contact details or any other data from the site
- Use vendor or customer contact details obtained here for unsolicited marketing
- Impersonate any person or business, or misrepresent your affiliation with one
- Upload viruses, malware or any code intended to damage or interfere with the platform
- Attempt to gain unauthorised access to any account, server or system, or probe or test our security
- Interfere with or place an unreasonable load on the platform's infrastructure
- Copy, frame or mirror any part of the site, or use it to build a competing directory
9. Intellectual Property
The MangalUtsav name, logo, design, text, graphics, software and the compilation of listings are owned by us or our licensors and are protected by intellectual property laws. You may not use them without our prior written permission.
Content uploaded by vendors and users remains theirs — the licence described above lets us display it on the platform, but ownership does not transfer to us.
If you believe content on our site infringes your rights, contact us at hello@mangalutsav.in with details of the content and your claim, and we will investigate.
10. Disclaimers
The platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose and non-infringement.
In particular, we do not warrant that:
- Any listing information is accurate, complete or current
- Any vendor is suitable, qualified, licensed, insured or will perform as promised
- The platform will be uninterrupted, timely, secure or error-free
- Any enquiry will result in a response or a booking
You are solely responsible for evaluating a vendor and for the terms of any arrangement you enter into with them.
11. Limitation of Liability
To the maximum extent permitted by law, MangalUtsav, its owners, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or connected with your use of the platform.
We are also not liable for any loss or damage arising from:
- The acts, omissions, conduct, service quality or non-performance of any vendor
- Any dispute, cancellation, delay, loss or damage relating to an event or booking
- Any payment made directly to a vendor
- Content posted by users or vendors
- Unauthorised access to your account or data resulting from your own failure to keep credentials secure
Where liability cannot be excluded, our total aggregate liability to you for all claims is limited to the amount you paid us in the twelve months before the claim arose, or ₹1,000, whichever is greater.
12. Indemnity
You agree to indemnify and hold harmless MangalUtsav, its owners, employees and affiliates from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your use of the platform, your content, your breach of these Terms, or your violation of any law or third-party right.
13. Suspension & Termination
You may stop using the platform at any time and ask us to close your account by emailing hello@mangalutsav.in.
We may suspend or terminate your account or listing, with or without notice, if you breach these Terms, if we are required to do so by law, or if we reasonably believe your use poses a risk to other users or to the platform. On termination, your right to use the platform ends immediately. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnity and governing law — will continue to apply.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they were last revised, and material changes will be announced more prominently. Your continued use of the platform after the changes take effect means you accept the revised Terms.
15. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to the paragraph below, the courts of competent jurisdiction in India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the platform.
Before starting formal proceedings, we ask that you contact us at hello@mangalutsav.in so we can try to resolve the matter informally.
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force. Our failure to enforce any right is not a waiver of that right.
